These Terms & Conditions (“Terms”) govern your access to and use of the Site and any services, content, tools, or functionality offered on or through the Site by Cabarrus Partnership for Children (“we,” “us,” or “our”). By using or accessing the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

These Terms constitute a binding agreement between you and Cabarrus Partnership for Children regarding your use of the Site. We may update these Terms from time to time; updated Terms will be effective when posted with a revised “Effective date.” Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

You must be at least 13 years old to use the Site. If you are under 18, you may use the Site only with involvement of a parent or guardian. By using the Site you represent and warrant that you meet these eligibility requirements.

3. Use of the Site — Permitted & Prohibited Conduct

You may use the Site for lawful, informational, and non-commercial purposes consistent with these Terms.

Prohibited conduct includes, but is not limited to:

  • using the Site for any unlawful purpose or in violation of applicable laws or regulations;
  • posting, transmitting, or sharing content that is defamatory, abusive, obscene, harassing, hateful, discriminatory, sexually explicit, or otherwise objectionable;
  • uploading viruses, malware, or other harmful code;
  • attempting to gain unauthorized access to our systems or other users’ accounts;
  • collecting or harvesting personal data about other users without their consent;
  • impersonating any person or entity or misrepresenting your affiliation with any person or organization;
  • reverse engineering, scraping, or otherwise attempting to access, copy, or extract data or content from the Site except as expressly permitted by us.

We reserve the right to monitor use of the Site, investigate violations of these Terms, and take any lawful action we deem appropriate (including suspending or terminating access and removing content).

4. Intellectual Property

All content on the Site — including text, graphics, logos, images, audio, video, design, code, and other materials — is owned or licensed by Cabarrus Partnership for Children and is protected by copyright, trademark, and other intellectual property laws. Except as expressly provided in these Terms, you may not copy, reproduce, republish, upload, post, transmit, distribute, modify, create derivative works of, or otherwise use Site content for any public or commercial purpose without our prior written consent.

You may download or print one copy of material from the Site for your personal, noncommercial use provided you retain all copyright and other proprietary notices.

5. User Content & Submissions

If you submit content to the Site (comments, feedback, stories, photos, or other materials) you grant us a perpetual, worldwide, royalty-free, non-exclusive, transferable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works of that content in any media. You represent and warrant that you own the content you submit or otherwise have the right to grant these rights, and that your content does not violate any law or the rights of any third party.

We are not responsible for any user-submitted content and do not guarantee its accuracy or suitability. We may remove, edit, or refuse any submissions at our discretion.

6. Donations, Payments & Fundraising

If the Site enables donations or payments, all donations are final unless otherwise stated. Payment processing is performed by third-party providers and is subject to the provider’s terms. We are not responsible for the acts or omissions of third-party payment processors. If you make a donation or purchase, you represent that you are authorized to use the payment method you provide.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CABARRUS PARTNERSHIP FOR CHILDREN DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CABARRUS PARTNERSHIP FOR CHILDREN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID (IF ANY) TO USE OR ACCESS THE SITE DURING THE PRIOR TWELVE (12) MONTHS, WHICHEVER IS GREATER, TO THE EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cabarrus Partnership for Children and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your violation of these Terms, your User Content, or your violation of any law or the rights of a third party.

12. Termination & Suspension

We may, in our sole discretion, suspend or terminate your access to the Site or any portion of it at any time, without notice and for any reason, including for violation of these Terms. Sections that by their nature survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive termination.

We strive to make the Site accessible to as many people as possible. If you have difficulty accessing any part of the Site or need assistance, please contact us and we will work to provide an accessible alternative.

14. Notices

We may send notices to you via email or by posting notices on the Site. Notice to Cabarrus Partnership for Children should be sent to us via the contact us form.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina without regard to conflict of laws principles. To the fullest extent permitted by law, you and Cabarrus Partnership for Children agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Cabarrus County, North Carolina, and you and we each submit to the personal jurisdiction of those courts.

16. Changes to the Site or Services

We may change, suspend, or discontinue any part of the Site or Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Site.

17. Children’s Privacy & COPPA

We do not knowingly collect personal information from children under 13 without verifiable parental consent. If we learn we have collected personal data from a child under 13 without parental consent we will delete that information as required by law. If you believe a child has provided us personal information without consent, please contact us.

18. Miscellaneous

Entire Agreement: These Terms, together with any documents expressly incorporated by reference (including the Privacy Policy), constitute the entire agreement between you and us regarding the Site.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Failure to enforce any right under these Terms will not be construed as a waiver of that right.
